Legal Support of National Digital Sovereignty

The article substantiates that the digital transformation of the economy raises the question of competition between states and global digital corporations in the struggle for a “stable connection” with economic agents, which inevitably undermines sovereignty through the erosion of “borders” in the internet space, the transfer by economic agents of information to cloud infrastructure that states do not control, the use of cryptocurrencies instead of national currencies, which prevents states from tracking payments even when national security is threatened, as well as through the simplification of international transactions by means of digital platforms, including anonymously. The author is convinced that states that manage to build a comprehensive system of legal, economic and institutional incentives for the development of their own digital infrastructure will gain a competitive advantage in the global economy, strengthen their independence from foreign policy fluctuations and withstand the competitive struggle for sovereignty with digital giants.
