IMPLEMENTATION OF A RISK-BASED MECHANISM FOR ESTABLISHING RESTRICTIONS ON LAND USE

Currently, the system for recording restrictions on land use is characterized by a conflict between the formal presence of data in the Unified State Register of Real Estate and the property holder's actual ability to assess the risks associated with using the property under such restrictions. The aim of this study is to develop a mechanism for implementing a risk-based approach to establishing restrictions, enabling the classification of land plots into specific risk categories. Unlike existing studies that apply the risk-based approach to control and supervisory activities, this research applies it for the first time to the establishment and recording of restrictions. The study proposes a procedural framework that includes data collection on restrictions, the calculation of a "burden index," and the assignment of the property to a risk category. The validity of the proposed mechanism is supported by a survey of citizens, which revealed that property holders have limited awareness regarding the nature and consequences of these restrictions. The proposed approach allows for the differentiation of restrictions based on the severity of the burden they impose and prescribes tailored regulatory measures for each risk category. This mechanism can be integrated into the existing record-keeping system. Its implementation facilitates the justification of cadastral value revisions, and the overall improvement of state land resource management.
