COMPATIBILITY OF THE FIDIC YELLOW BOOK (MDB HARMONISED EDITION) WITH UZBEKISTAN’S CONSTRUCTION REGULATIONS IN DESIGN-AND-BUILD CONTRACTS

This article examines the compatibility of the FIDIC Yellow Book (MDB Harmonised Edition) with Uzbekistan’s construction regulatory framework in design-and-build contracts. Particular attention is given to the relationship between the contractual allocation of design responsibility, the application of national construction norms and rules (KMK/SHNQ), mandatory state expertise, approval procedures, and the legal consequences of discrepancies between international contract conditions and domestic regulatory requirements. The article argues that effective compatibility depends not on the automatic priority of one framework over another, but on the accurate identification of mandatory national requirements, the legal status of financing and contractual documents, and the establishment of clear procedures for design review, regulatory compliance, and change management. Practical recommendations are proposed for reducing legal uncertainty, preventing delays, and improving the administration of internationally financed construction projects in Uzbekistan.
