Debt Collection Oversight in Latvia: Consumer Protection and Institutional Accountability

This evidence-based legal working paper examines consumer debt collection, judicial enforcement and institutional accountability in Latvia, with particular reference to proceedings involving OÜ Aktiva Finance Group, SIA Julianus Inkasso Latvija and sworn bailiff Sandra Paegle. The study analyses Latvian civil case C33341326, enforcement proceedings 04258/079/2026, judicial decisions issued in July, September and October 2026, and relevant cross-border supervisory correspondence. Particular attention is given to the transparency of debt calculations, the proportionality of vehicle-related enforcement restrictions, the accessibility of judicial remedies, and the respective responsibilities of courts, enforcement officers and regulatory authorities. The research distinguishes established judicial findings from allegations, documentary discrepancies and unresolved legal questions. It considers relevant Latvian legislation, European Union consumer-protection law, the EU Charter of Fundamental Rights and the European Convention on Human Rights. The purpose of this publication is to support independent legal scrutiny, institutional transparency and evidence-based discussion of consumer protection and access to justice. Research limitations: The underlying documentary collection was assembled from materials provided by a participant in the proceedings and has not been independently authenticated against the complete official case files. The study does not establish fraud, corruption or professional misconduct. Its findings remain subject to further verification and responses from the relevant institutions.
