UNDERMINE REPRESENTATION OF SOUTHERN PART OF INDIA THROUGH DELIMITATION - an Extensive Analysis

Abstract The impending 2026 delimitation exercise represents a critical juncture for India’s federal structure and democratic integrity. This analysis explores the governing constitutional framework and investigates how divergent demographic patterns between the northern and southern states have created an unprecedented challenge for equitable representation. Population projections indicate a significant geopolitical power shift, where northern states stand to gain parliamentary seats while southern states face a net loss, fundamentally altering federal power dynamics. Because southern states successfully implemented national population stabilization policies, this undermined representation threatens democratic fairness and deepens regional disparities. In this research paper analyses the long-term freeze's effects, focusing on the increasing imbalances in representation among states with varying population growth rates. Conversely, northern states assert their constitutional right to representation based on absolute population figures, citing greater infrastructure demands and resource requirements. This article evaluates these competing perspectives and proposes innovative structural solutions. These include revised allocation formulas, robust constitutional safeguards, and international adaptations such as Germany’s weighted voting system, the European Parliament’s digressive proportionality, legislative downsizing seen in Hungary and Italy, and the statutory boundary and seat caps implemented in the United States, Japan, Malaysia, and Switzerland to maintain federal equilibrium and optimize public expenditure. Ultimately, this research concludes that India must pioneer representation mechanisms that balance demographic realities with federal stability through creative constitutional models ensuring that population size is acknowledged without penalizing states for the successful execution of national development policies.
