EXAMINATION OF LEGAL FRAMEWORK FOR LAND USE CHARGE VALUATION IN OYO STATE
This article critically examines the legal framework governing the valuation of real property under the Oyo State Land Use Charge (LUC) Law. Designed to consolidate property based taxes and enhance Internally Generated Revenue (IGR), the LUC legislation adopts a formula based valuation methodology rather than traditional market value appraisal techniques. This paper interrogates the statutory provisions of the Oyo State Land Use Charge Law, 2012 (as amended and re enacted in 2020 and 2023), focusing on the valuation formula, constitutional tensions surrounding subnational vs. local government rating powers, administrative enforcement, and dispute resolution mechanisms. Furthermore, this study evaluates the empirical highlighting literature, professional estate surveying standards, key decisions of the Supreme Court of Nigeria, and statutory conflicts. The article concludes with actionable recommendations to align property tax valuation in Oyo State with constitutional mandates, valuationprofessional standards, and equitable tax principles.
