Artificial Intelligence in Modern Criminal Forensics in India: Opportunities and Challenges

Artificial Intelligence (AI) is rapidly transforming the field of criminal forensics in India by enhancing the efficiency, speed and accuracy of criminal investigations. AI-powered technologies such as facial recognition systems, predictive analytics, biometric identification, digital surveillance and machine learning algorithms are increasingly being used by investigative agencies to analyse evidence, identify suspects and detect criminal patterns. In the context of rising cybercrimes, organized crimes and digital offences, AI has emerged as a significant tool for modernizing forensic science and strengthening the criminal justice system. Despite its advantages, the use of AI in criminal forensics also raises several legal, ethical and constitutional concerns. Issues relating to privacy, data protection, algorithmic bias, lack of transparency and reliability of AI-generated evidence pose serious challenges to the Indian legal framework. The absence of comprehensive legislation regulating AI usage in criminal investigations further creates uncertainty regarding accountability and admissibility of AI-based evidence in courts. Additionally, overdependence on automated systems may threaten fundamental rights and procedural fairness if proper safeguards are not implemented. This paper critically examines the opportunities and challenges associated with the application of AI in modern criminal forensics in India. It explores the technological advancements, their impact on forensic investigations and the need for a balanced legal and regulatory framework that ensures both effective crime detection and protection of individual rights in a society.
