Navigating Constitutional Safeguards: A Critical Analysis of the ECI’s Independence under the Appointment Act, 2023 Piyush Singh* The Indian Election Commission plays an important role in the functioning of Indian democracy. The Constitution's Article 324 provides supervision, direction, and control over the creation of electoral rolls and the conduct of elections. This paper investigates the actual implications of such constitutional framework on the Commission's independence. It examines how members are chosen, the safeguards they have while in office, the restrictions the Supreme Court has imposed on their authority, and the real-world challenges that the organization still faces. The conversation is based on rulings in cases like Mohinder Singh Gill, T.N. Seshan, Anoop Baranwal, and the more recent ruling on Bihar's particularly rigorous revision of voting rolls. It also takes into account the Appointment Act, 2023 that presently controls appointments. Independence is not a label that can be attached once and for all. It depends on transparent selection, security of tenure, freedom from political pressure, and the steady discipline of judicial review. At the same time the Commission remains bound by the Constitution and by valid legislation.
