FESS >< FCLS >< FHESS — Communication XX examines an empirically encountered and continuing configuration connecting publicly documented warnings concerning decision-making centres, subsequent and continuing attacks in Ukraine, damage and victim positions, and the question of timely judicial capacity within the Rome Statute framework. The Communication develops the INTERIMINTERVALₒ as the interval in which assigned judicial capacities remain available while a developing factual and legal configuration continues to take shape. It places CARE ACCESSₒ >< ATTRIBUTION ACCESSₒ, interim judicial decisions, evidentiary and protective capacities, and the relation between the judicial CORNERSTONEₒ, TRUSTₒ, FAIR PLAYₒ and JUDICIAL INNERVATIONₒ within the research framework of TRIAS POLITICA 3.0ₒ. The empirical material includes warnings concerning decision-making centres, attacks affecting Kyiv and Kramatorsk, newly arising damage and victim positions, and the encountered position of immobilised Russian assets. The accompanying doctrinal analysis makes identifiable Rome Statute access points readable, including protective asset measures, cooperation concerning assets, possible forfeiture following conviction, and victim-oriented statutory capacity. Communication XX proceeds as an OPEN BOOKₒ: it makes the encountered configuration and its statutory engagement points available while preserving the competent ICC organs’ own KRINEINₒ concerning evidence, causation, attribution, legal qualification, individual criminal responsibility and the availability of particular judicial measures. The Communication and its annexes were submitted to the Office of the Prosecutor of the International Criminal Court on 9 October 2026. The submission asks which investigative, protective, evidentiary and judicial capacities the ICC can make timely available within its assigned Rome Statute competence as the encountered configuration continues to develop.
