主権的報復のスペクタクル:生中継される死刑執行・憲法規範の侵食・近代刑罰学の歴史的逆行 The Spectacle of Sovereign Retribution: Televised Capital Punishment, Constitutional Erosion, and the Regression of Modern Penology
概要 / Abstract(日本語) 本批判的法学論考は、米国防長官ピート・ヘグセスにより提唱されたニダル・ハサン元少佐の銃殺執行の公衆中継構想を対象とし、その憲法規範的および刑罰史的帰結を厳密に解明する。国家による致死力行使の映像化および視覚的拡散は、近代刑罰学が数世紀にわたり構築してきた身体刑から規律訓練的修正への発展史を根底から解体し、前近代的な処刑台の見せしめ劇場の再興をもたらす。法理的分析において、死刑執行のメディア中継は単なる執行方法の選択にとどまらず、合衆国憲法修正第8条が禁止する「残虐で異常な刑罰」に該当し、トロップ対ダレス判決に掲げられた体面の発展的基準に対する明白な侵害を構成する。ミシェル・フーコーの国家主権論およびデイヴィッド・ガーランドの刑罰社会学を準拠枠組みとして、主権的暴力のポピュリズム的兵器化と、それが市民的共感および法治主義に及ぼす頽廃的影響を詳述。国際人権規約第7条などの国際法規との衝突を検証し、権威主義的暴力に対する憲法規範の絶対的不可侵性と人間の尊厳を防衛する論理を確立する。 Abstract(English) This critical jurisprudence monograph examines the proposal by Defense Secretary Pete Hegseth to broadcast the firing squad execution of Maj. Nidal Hasan to the global public. Analyzing this initiative as an acute institutional crisis, this paper formalizes how the televised mediation of state violence actively dismantles the core tenets of modern penology, reversing historical evolutions from physical torture on the public scaffold to bureaucratic, disciplinary correction. The study demonstrates that broadcasting state killing constitutes an independent constitutional violation under the Eighth Amendment of the United States Constitution by directly breaching the "evolving standards of decency that mark the progress of a maturing society" (Trop v. Dulles). Drawing upon Michel Foucault’s critique of sovereign power and David Garland’s sociology of punishment, this monograph details the socio-political mechanics through which capital punishment is weaponized as mass entertainment and authoritarian signaling, concluding with an unyielding reassertion of constitutional governance and human dignity against the populist resurgence of sovereign violence.
