物理層の確定性と制度的連動:暗号論的アテステーションと自己資本規制ペナルティによる生成的システムリスクの封じ込め Physical-Layer Determinism and Statutory Interlocks: Mitigating Generative Systemic Risk via Cryptographic Attestation and Capital Adequacy Penalties
概要 / Abstract(日本語) 生成基盤モデルが金融機関や企業の基幹システムへ急速に統合される中、確率論的推論の不確定性がもたらす生成的システムリスクが深刻な課題となっています。本論文は、ソフトウェア上の曖昧な自然言語ガードレールを排し、半導体シリコンの物理層における確定的な実行痕跡と、国際的な自己資本規制および企業統治法規を直結させる包括的ガバナンス・フレームワークを提示します。 セキュア・エンクレイヴ内部で生成されるゼロ知識証明を用いた非学習アテステーション・プロトコルを定式化し、推論時にモデルの重み更新が行われていないことを数学的に証明します。さらに、この物理証明をバーゼルIIIにおけるリスク・ウェイト資産加算ペナルティ、欧州デジタル運用耐性法DORA、ISO/IEC 42001適合性評価、およびケアマーク教義に基づく取締役の善管注意義務違反責任と連動させる三位一体の制度設計を確立。検証不可能なブラックボックスモデルを運用する企業に対して資本市場側から是正を強制し、市場全体の破滅的なリスク伝染を不可逆的に遮断する論理的妥当性を論証します。 Abstract(English) This monograph presents an institutional and cryptographic framework to mitigate generative systemic risk arising from the integration of probabilistic foundation models into enterprise financial infrastructures. By replacing vulnerable software-level guardrails with deterministic physical-layer execution traces, we propose the non-learning attestation protocol using zero-knowledge proofs generated within secure hardware enclaves to verify that model weights remain immutable during inference. Furthermore, this hardware root of trust is directly coupled with global regulatory mechanisms, including Basel III Risk-Weighted Asset surcharges, EU Digital Operational Resilience Act mandates, ISO/IEC 42001 audit standards, and the Caremark fiduciary duty doctrine, establishing an irreversible economic and legal boundary against automated systemic contagion
