概要 / Abstract(日本語) 本論文は、エンタープライズ向けAIプラットフォームが複数の異種基盤モデルを動的にオーケストレーション(相互接続・ルーティング)する際に生じる、構造的なガバナンス不全と法的責任の不可視化を理論的に解明する。事前学習段階における無断著作物スキャンやデータ汚染といった上流の法的欠陥が、エージェント連携レイヤーを経由して下流の利用企業へと不可逆的に伝染し、バランスシート上の潜在債務や受託者責任の希釈化を引き起こすメカニズムを定式化。確率的な出力マスク処理ではモデル重み内の侵害毒素を洗滌できないことを証明するとともに、プラットフォーム企業が主張する中立的導管論の破綻を説き、共同事業法理に基づく連帯責任を論証する。解決策として、暗号学的ハードウェア認証と連動したAI部品表(AI-BOM)ドクトリンを提示し、確定的責任連鎖の確立を提言する。 Abstract(English) This monograph presents a structural analysis of governance vulnerabilities arising when enterprise AI platforms dynamically orchestrate heterogeneous foundation models. As cloud providers route prompts and context histories across competing frontier models, corporate liability boundaries dissolve. We formalize how upstream data procurement liabilities—specifically unconsented copyrighted text ingestion during pre-training—propagate downstream through cross-model execution layers, contaminating enterprise balance sheets and diluting fiduciary duties. We demonstrate that output-level filtering fails to neutralize latent copyright infringement embedded within neural weights, dismantle hyperscaler neutral conduit defenses via joint enterprise liability doctrine, and formulate a mandatory AI Bill of Materials (AI-BOM) coupled with cryptographic attestation for end-to-end supply-chain traceability.
