Integrated Legal and Patrimonial Planning for Continuity of Care in Neurodivergent People and Their Families in Brazil

Continuity of care for neurodivergent people requires coordination between individual preferences, practical support, financial resources, and lawful arrangements for decision-making and property administration. Families may prepare inheritance or identify future caregivers without resolving how these components will operate together. This study examines Brazilian legal instruments and family planning practices relevant to long-term care continuity and patrimonial protection, with particular attention to autonomy, succession, family governance, and the potential role of family holding companies. A narrative literature review was combined with documentary analysis of Brazilian legislation and official judicial information. The synthesis included 60 sources addressing future planning, family caregiving, supported decision-making, adult transitions, succession, and resource management, including publications from 2026. Findings were organized into interrelated planning domains and presented through three comparative tables and four conceptual flowcharts. The analysis distinguished ownership from administration, asset value from accessible funds, and patrimonial authority from responsibilities for everyday care. Wills, gifts, usufruct, insurance, and corporate arrangements may address specific objectives, but no instrument independently ensures sustainable support. Family holding companies require individualized assessment of governance, costs, lawful access to resources, and management succession. Participation of the person receiving support, explicit negotiation of responsibilities, preparation of alternative supporters, and coordination with public and community services emerged as central planning considerations. Current challenges include inaccessible information, limited services, caregiver strain, financial uncertainty, and delayed preparation for transitions. Future priorities include participatory Brazilian research, accessible professional assistance, comparison of feasible alternatives, and longitudinal evaluation of implementation. The framework is a conceptual synthesis rather than evidence of intervention effectiveness. Integrated planning should connect legal and patrimonial organization with workable arrangements for the person’s continuing daily life, preserving autonomy and revising responsibilities as circumstances change. These arrangements should remain understandable to participants and responsive to changes in housing, health, income, services, and the availability of agreed supporters.
