Role of Judiciary for Speedy Disposal of Cases: An Empirical Study on the Indian Criminal Justice System

The problem of delay is colossal, with huge pendency in respect of arrears of cases in different Courts of India. The judiciary has a pivotal role to play in maintaining the rule of law, ensuring that justice is served promptly, and boosting public trust in the legal system. The researchers, through the empirical study, investigate the challenges or factors that the Judges in India have to face, like systemic inefficiencies, procedural complexities, infrastructural deficits, and judicial workload as critical factors contributing to delays. The researchers find that delays in the trial process within the Indian criminal justice system are a persistent and complex issue, rooted in a combination of structural, procedural, and administrative factors influencing the speedy justice delivery. Thus, this paper concludes by suggesting certain changes that can be adopted for speedy disposal of cases in India and to ensure that the case backlog is reduced and that attempts are made to improve case disposition.
