Penerapan Rehabilitasi Sosial Terhadap Pecandu Narkotika Sebagai Pidana Alternatif Di Rumah PABM Nawacita Yogyakarta
This study analyzes the legal regulation of social rehabilitation as an alternative sentence for narcotics addicts under Indonesian legislation and examines its implementation as legal protection based on the principle of utility at Rumah PABM Nawacita Yogyakarta. The research uses a normative-empirical method with statutory and sociological approaches. Primary data were obtained through interviews and observation, while secondary data consisted of primary and secondary legal materials. The results show that social rehabilitation has a sufficient normative basis through Law Number 35 of 2009 concerning Narcotics and its implementing regulations, including rules on mandatory reporting, assessment, rehabilitation institutions, and inter-institutional coordination. Nevertheless, implementation remains influenced by assessment procedures, law-enforcement discretion, inter-agency coordination, and the availability of rehabilitation facilities. At Rumah PABM Nawacita Yogyakarta, clients enter rehabilitation voluntarily, through family referrals, or through referrals from BNN and the Police following assessment. The program lasts approximately five to six months and includes individual and group counseling, group therapy, character development, spiritual and social activities, and aftercare. The implementation produces benefits reflected in behavioral change, responsibility, life discipline, self-confidence, and restoration of social functions. Thus, social rehabilitation at Rumah PABM Nawacita Yogyakarta reflects legal protection oriented toward utility for clients, families, and society.
