Protecting the Rights and Health of Intersex Children Seeking Asylum: A Child Rights Approach to Qualification as a Refugee for Intersex Children

Abstract Research on the position of intersex persons within the international refugee law system is extremely limited. Intersex persons are commonly grouped with LGBT+ issues within policy guidance, but little attention has been given to the specificity of intersex children’s needs. This Article aims to develop an approach to intersex refugee law from the perspective of children’s rights and health law. To do so, it will largely focus on the ways in which the current refugee law framework should be used to provide effective protection to intersex children, particularly when accompanied by their parents or legal guardians to flee harmful practices. Such research will rely on the work of the Committee on the Rights of the Child and other UN bodies which have slowly centered intersex issues in their works. Altogether, this Article aims to provide an overview of the current situation of intersex children seeking asylum, as well as avenues for developing better practices.
