Financial Barriers to Access to Justice in Latvia: A Documentary Case Study of Court Fees, Financial Incapacity and Procedural Safeguards (2026)
This independent legal research working paper examines how court-fee requirements interact with documented financial incapacity and effective access to justice in Latvia. Using five original primary-source documents from Latvian judicial and administrative proceedings, the study analyses a EUR 1,050 court-fee requirement alongside documentary evidence of near-zero bank balances and registered unemployment status.The paper examines the relationship between procedural fee requirements, means-based exemptions, procedural sequencing and the practical effectiveness of judicial protection under Article 92 of the Constitution of Latvia (Satversme), Article 6 of the European Convention on Human Rights, and Article 47 of the Charter of Fundamental Rights of the European Union.The study applies a documentary methodology that distinguishes factual observations derived from primary-source records from legal inference. It also proposes an eight-step court-fee safeguard protocol and considers the potential role of AI-supported document analysis and traceable judicial administration in strengthening procedural accountability and access to justice.The publication includes five primary-source exhibits from the 2026 administrative and judicial record.
