Penerapan Asas Aman oleh Kantor Pertanahan Kota Medan dalam Proses Pendaftaran Tanah Pertama Kali (Studi di Kota Medan)
The first land registration is an important stage in providing certainty and legal protection for land rights. The safe principle as one of the principles of land registration requires that the implementation of registration be carried out carefully and carefully so that the physical and juridical data produced provide security guarantees for rights holders. This study aims to analyze legal arrangements regarding the application of the safe principle in land registration for the first time in Indonesia, its application by the Medan City Land Office, as well as the legal consequences for land certificates and land offices if the principle is not applied. This study uses normative and empirical legal research methods with primary, secondary, and tertiary data sources obtained through literature studies and field research. The results of the study show that the safe principle has a legal basis in land laws and regulations, especially Government Regulation Number 24 of 1997 concerning Land Registration. Its implementation by the Medan City Land Office is carried out through the examination and verification of physical and juridical data, measurement and mapping, document validation, and supervision at the registration stage. The non-application of the safe principle can cause administrative defects that result in weak certificate proving power, the possibility of cancellation if proven to be legally flawed, as well as legal and administrative consequences for the Land Office in accordance with laws and regulations, as well as increasing the potential for land disputes and legal uncertainty for interested parties.
