Comprehensive Legal Analysis: Procedural Violations, Enforcement Flaws, and Fundamental Rights Infringements in Cross-Border Debt Enforcement within the European Union
This analytical case study examines alleged procedural irregularities, inconsistencies in enforcement documentation, calculation of enforcement costs, electronic document authentication, creditor representation, and fundamental-rights implications arising from debt-enforcement proceedings in Latvia within a cross-border European Union context. The study is based on documentary materials relating to Case No. C33341326 and Enforcement Case No. 04258/079/2026. It compares the underlying judicial decision, enforcement documentation, the recorded status of the creditor and its authorised representative, enforcement-cost calculations, and communications issued during the enforcement process. The analysis considers Latvian civil procedure and enforcement law alongside the European framework of effective judicial protection, including Article 19(1) of the Treaty on European Union, Article 47 of the Charter of Fundamental Rights of the European Union, and Article 6 of the European Convention on Human Rights. Particular attention is given to procedural transparency, consistency of enforcement records, verifiability of enforcement costs, electronic-document authenticity, cross-border representation, and the practical effectiveness of remedies available during the enforcement stage. The publication is intended as an open-access legal case study and documentary resource for academic, professional, and institutional examination of procedural safeguards in civil enforcement and cross-border debt recovery within the European Union.
