A Decade of Transitional Justice in Colombia: The Contest Between Orthodoxy and Transformation

This article critically assesses the implementation of Colombia’s Comprehensive System of Truth, Justice, Reparation and Non‑Repetition (SIVJRNR) between 2016 and 2026. Although the Final Agreement established a design with transformative potential, practice has tended toward a hybrid form here labeled “orthodox transitional justice”: a state‑centric, technocratic model, embedded in the liberal‑peace framework, that privileges formal procedures and prosecutions while paying insufficient attention to structural violence and the agrarian dimension of the conflict. Based on documentary review and territorial evidence, the study examines the SIVJRNR’s institutional architecture, its performance across the pillars of truth, justice, reparations and non‑repetition, the factors behind the gap between design and outcomes, and proposals to reorient the model toward accountability and redistribution. Findings show robust diagnostics alongside persistent deficits: slow land restitution, underfunded programs, limited sanctioning of economic responsibility, and continuing insecurity. Overcoming these limits requires linking truth to redistributive policy and effective victim protection. Este artículo evalúa críticamente la implementación del Sistema Integral de Verdad, Justicia, Reparación y No Repetición (SIVJRNR) en Colombia entre 2016 y 2026. Aunque el Acuerdo Final estableció un diseño con potencial transformador, la práctica institucional ha tendido hacia una forma híbrida aquí denominada “justicia transicional ortodoxa”: un modelo estatocéntrico y tecnocrático, inscrito en el marco de la paz liberal, que privilegia los procedimientos formales y las judicializaciones, con atención insuficiente a la violencia estructural y a la dimensión agraria del conflicto. A partir de la revisión documental y de evidencia territorial, el estudio examina la arquitectura institucional del SIVJRNR, su desempeño en los pilares de verdad, justicia, reparación y no repetición, los factores que explican la brecha entre el diseño y los resultados, y propuestas para reorientar el modelo hacia la rendición de cuentas y la redistribución. Los hallazgos muestran diagnósticos sólidos junto a déficits persistentes: restitución de tierras lenta, programas subfinanciados, capacidad limitada para sancionar la responsabilidad económica e inseguridad continua. Superar estos límites exige vincular la verdad con la política redistributiva y una protección efectiva de las víctimas.
