ANALYSIS OF REGULATORY IMPACT ASSESSMENT IMPLEMENTATION PRACTICES IN THE DEPARTMENT OF PROPERTY AND HOUSING RELATIONS (A CASE STUDY OF THE MAGADAN CITY ADMINISTRATION)

This article analyzes the implementation of Regulatory Impact Assessment (RIA) practices within the Department of Property and Housing Relations. The topic is highly relevant given RIA’s pivotal role as a tool for improving the quality of regulatory legal acts, aimed at identifying excessive obligations and mitigating the negative regulatory impacts on businesses and citizens. The study examines the theoretical foundations of RIA, including its objectives (such as preventing harm and exploring alternatives) and types (preliminary assessment of draft acts versus retrospective assessment of existing regulations). It also addresses procedural aspects, such as interaction with authorized bodies and requirements for completing RIA reports—covering problem definition, objectives, alternatives, and the quantitative assessment of costs. Of particular interest is the analysis of cases illustrating the "blocking status" of RIA, where a failure to adhere to procedural discipline—such as modifying a draft act after the RIA process without conducting a re-assessment—served as grounds for refusing to sign the document. The conclusion assesses the effectiveness of current RIA mechanisms, identifies common issues (e.g., insufficiently substantiated reports, difficulties in quantifying impacts, and incomplete information disclosure), and proposes ways to improve practices by drawing on best regional and international approaches.
