Court Fees and the Right of Effective Access to a Court: A Legal Analysis of Proportionality, Current Financial Capacity and Excessive Procedural Formalism in Latvian Civil Procedure

This bilingual working paper examines the relationship between court fees and the effective right of access to a court in Latvian civil procedure. It analyses when a formally lawful financial requirement may become a practical barrier to adjudication on the merits. The study focuses on current financial capacity, evidentiary completeness, procedural good faith, proportionality and excessive procedural formalism. Particular attention is given to the temporal assessment of a litigant's ability to pay, the distinction between subsistence resources and litigation-payment capacity, and the separate consideration of full exemption, partial exemption and deferral of court fees. The analysis is grounded in a documented Latvian civil case in which a EUR 4,800 court fee was imposed at the initial stage of proceedings. The paper examines the issue through Article 92 of the Constitution of Latvia, Article 6(1) of the European Convention on Human Rights, Latvian Supreme Court and Constitutional Court jurisprudence, and relevant European Court of Human Rights case-law. The publication distinguishes documentary facts, propositions of positive law and case-law, and the author's analytical conclusions.
