International Election Observation and Civil Society Participation in Parliamentary Elections
Abstract This article examines the legal framework of international election observation and the role of civil society organisations in monitoring parliamentary elections. It analyses the international and regional legal instruments that establish the right to participate in public affairs and to vote and stand for election in genuine periodic elections, with particular reference to the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights, the Arab Charter on Human Rights, and relevant African instruments. The article also distinguishes election observation from electoral assistance, certification and supervision, proposes working definitions of observation and monitoring, and examines the mandates and methodologies of selected international and regional organisations. It then compares the current legal frameworks of Egypt and Tunisia against six criteria: legal basis, accreditation authority, access to information and polling stations, independence of observers, reporting, and the legal significance of findings. The study adopts a doctrinal and comparative legal approach based on international instruments, domestic legislation and institutional materials. It argues that effective election observation depends on a clear legal framework, institutional independence, access to electoral information, transparent accreditation procedures and the ability of observers to report their findings without interference. Civil society observation can complement international observation by providing domestic scrutiny throughout the electoral cycle, but its effectiveness depends on safeguards concerning independence, impartiality, equal access and transparency. The article concludes that international and domestic observation should operate as complementary mechanisms while remaining distinct from the functions of electoral administration and adjudication.
