Navigate uncertainty over emotional support animals
The U.S. Department of Housing and Urban Development has thrown the future of emotional support animal accommodations from no pet rules into doubt. Its recent notice rescinded its past guidance that it will no longer issue cause findings arising from denial of ESA accommodations requests. HUD will move forward with complaints only when the animal in question is task‐ or work‐trained to benefit a person with a disability, paralleling the service animal regulations under the Americans with Disabilities Act. What does this mean for campus housing?
