DECISION: REJECT ELEMENT: No element survives — the NY_OPEN + 5-conf filter is a statistical artifact on n=12, not a geometric edge. E8 rhythm logic already encodes time-of-day via Gods-Clock; adding a redundant time filter risks double-counting the same session bias. The 5-conf threshold is arbitrary — no mechanism ties confidence value 5 to NY_OPEN short quality. EXPECTED IMPACT: Win-rate improvement would be ~0% in live forward trading. The backtest delta (+27.2pp) is within noise for n=12 (95% CI roughly ±25pp). Even if real, XAUUSD shorts are a minority of trades — portfolio win-rate lift <2pp, profit impact negligible after spread/slippage. RISK: Overfitting to a specific macro regime (July-Aug 2024 gold selloff). Filter would block valid high-conviction shorts during trending NY sessions, reducing R-multiple capture. Also, the filter does not address the systemic GTX loss ratio (191L vs 111W) — it's a band-aid that could mask deeper E8-node timing drift.
