INSTITUTIONS OF LAND MANAGEMENT ECONOMICS IN REGULATING CONFLICT SITUATIONS RELATED TO LAND DISTRIBUTION IN THE REGION

The article examines the problem of interaction between land management institutions and agricultural cooperation in the context of regulating conflict situations arising during land redistribution. The relevance of the work is due to the insufficient consistency of the regulatory framework governing land management and cooperative relations, which creates significant barriers to the consolidation of land within agricultural cooperatives and reduces the efficiency of their economic activities. The aim of the study is to identify legal barriers hindering the effective interaction between land management and cooperation, as well as to propose a set of measures to improve the regulatory framework and mechanisms for resolving land conflicts. The methodological basis of the work consisted of an analysis of federal and regional regulatory acts (including Federal Law “On Land Management” No. 78‑FZ, Federal Law “On Agricultural Cooperation” No. 193‑FZ, and Krasnodar Krai Law No. 532‑KZ), a historical and legal analysis of the land reform of the 1990s, as well as an assessment of the practice of cadastral accounting and on‑farm land management in cooperative structures. The study established that the norms regulating land management and cooperation are enshrined in disparate legal acts and are poorly integrated with each other. In particular, the Federal Law “On Land Management” does not contain special provisions that take into account the specifics of cooperative forms of economic activity, and the Federal Law “On Agricultural Cooperation” does not regulate land management procedures and mechanisms for resolving disputes between cooperative members. Significant difficulties are also associated with the labor‑intensive nature of cadastral registration of combined land plots and the insufficient digitalization of land management processes. At the regional level, there is duplication of federal regulations without adaptation to the natural and economic conditions, which reduces the practical applicability of the legislation. A set of measures has been proposed to eliminate the identified barriers: amendments to federal laws to regulate the procedure for combining land shares, on-farm planning and zoning in cooperatives, as well as mechanisms for resolving land disputes; development at the regional level of methodological recommendations on land management for cooperatives, taking into account the specifics of the Krasnodar Territory; simplification of cadastral registration procedures, including accelerated registration of changes in the EGRN; promotion of digitalization through subsidizing the introduction of geographic information systems and the creation of a single digital platform; expansion of government support measures, including the provision of subsidies for land management work, tax incentives and training programs for cooperative specialists.
