LEGAL FRAMEWORK FOR DIGITAL SUCCESSION AND POSTHUMOUS PRIVACY IN INDIA

The rapid growth of the digital economy means that online accounts, digital assets, and personal information have become a part of one’s property. The Indian legal framework, however, resolves the issue of inheritance based on statutes that have been introduced many years before the existence of the concept of digital assets. While the Indian Succession Act, 1925, Information Technology Act, 2000, and Digital Personal Data Protection Act, 2023 and other acts regulate the issues of succession, electronic information and personal data, none of them introduces the complete concept of digital succession. This paper critically examines the current legislation, developments in judiciary and comparative jurisprudence to determine the loopholes present in Indian law. This research paper seeks to demonstrate that digital identity is a unique legal interest and suggests a statute for addressing the problems.
