Procedural Memorandum on E-Justice Accessibility: Effective Judicial Protection, Digital Barriers and Procedural Deadlines in Latvi

This publication examines technological and procedural barriers to effective access to justice arising from electronic judicial communication in Latvia. Using Case No. 3-11/0775/46 as a documented case study, it analyses whether procedural deadlines can operate effectively where a party encounters technical barriers to accessing a judicial decision. The paper examines the issue under Article 19(1) TEU, Article 47 of the Charter of Fundamental Rights of the European Union, Regulation (EU) No 910/2014 (eIDAS), and Article 6 of the European Convention on Human Rights. Particular attention is given to the requirement that access to justice must be practical and effective rather than theoretical or illusory. The publication contains both Latvian and English legal analysis and includes documentary evidence relating to the underlying judicial communication. It addresses broader implications for e-Justice, procedural fairness, technological accessibility, effective judicial protection and the rule of law.
