SATELLITE INTERNET AND THE FUTURE OF TELECOMMUNICATIONS REGULATION IN NIGERIA: LEGAL IMPLICATIONS OF STARLINK AND LOW-EARTH-ORBIT TECHNOLOGIES

The rapid deployment of satellite internet services and low-earth-orbit (LEO) technologies is transforming the telecommunications landscape by providing high-speed connectivity beyond the traditional reach of terrestrial networks. In Nigeria, the emergence of Starlink and similar satellite-based internet services presents significant opportunities for addressing broadband deficits, extending connectivity to underserved communities, and promoting digital inclusion. At the same time, these technologies raise complex legal and regulatory questions concerning licensing, spectrum management, consumer protection, data privacy, cybersecurity, taxation, competition, quality of service, and national security. This article examines the implications of satellite internet and LEO technologies for the future of telecommunications regulation in Nigeria, with particular attention to the regulatory challenges associated with Starlink’s operation within the Nigerian telecommunications market. This study evaluates the adequacy of the Nigerian Communications Act 2003, the regulatory mandate of the Nigerian Communications Commission (NCC), applicable spectrum management rules, and other relevant legal instruments in responding to rapidly evolving satellite technologies. The article further examines the interaction between satellite internet regulation and the Nigeria Data Protection Act 2023, Cybercrimes legislation, consumer protection standards, and national security requirements. Conventional telecommunications regulation, historically designed around terrestrial networks and geographically identifiable operators, requires adaptation to accommodate the borderless and technologically distinctive character of LEO satellite services. The article recommends a technology-neutral and innovation-sensitive regulatory framework that incorporates proportionate licensing, effective spectrum governance, cybersecurity safeguards, consumer protection, data accountability, fair competition, and cross-border regulatory cooperation. It concludes that properly calibrated regulation can enable Nigeria to harness LEO technologies as instruments of digital transformation while preserving regulatory sovereignty, public interest, and fundamental rights
