Reforming the law commission: Broader institutional representation
This article argues that the Law Commission of England and Wales requires structural reform on two fronts. First, drawing on the Commission's 2024 decision to relaunch a comprehensive review of homicide law despite exhaustive prior treatment in its 2006 report, the partial reforms enacted through the Coroners and Justice Act 2009, and Clare Wade KC's targeted 2023 recommendations on domestic homicide sentencing, the article contends that the Commission should exercise greater institutional autonomy over topic selection and the negotiation of terms of reference, rather than functioning primarily as a passive executor of government-directed projects. It argues that this reactive model produces systematic bias toward politically salient but analytically saturated subjects, while urgent modernisation of technical areas — including insolvency offences, the Computer Misuse Act 1990, tax enforcement statutes, forgery law in the era of deepfakes, the Proceeds of Crime Act 2002, and criminal liability for autonomous AI agents — is neglected. Second, the article advocates expanding the Commission's representative structure beyond its current four-commissioner model, drawing selectively on the American Law Institute's broader membership of judges, practitioners and academics, to widen the base of specialist expertise and institutional legitimacy. It proposes a hybrid model combining a core of full-time commissioners with an expanded body of fixed-term specialist members, and situates this proposal within comparative institutional examples, including the ALI and the scale of judicial specialisation in China's Supreme People's Court.
