Stacking the deck: Multi‐layer IP strategies in onion breeding

Abstract Onion hybrid breeding presents a distinctive intersection between plant biology and intellectual property law. Unlike many crops, such as maize, in which hybrid protection relies primarily on reduced performance and loss of heterosis in subsequent generations, onion hybrids are frequently cytoplasmic male sterile, rendering conventional seed saving from the commercial hybrid impossible. This article examines how this biological characteristic functions as an implicit proprietary mechanism that complements formal intellectual property rights. The analysis demonstrates that onion breeding has developed into a multi‐layered system of control encompassing plant breeder's rights, patents on traits and genetic material, molecular markers, breeding methods, and lineage‐verification technologies. Case studies involving low‐pungency onions, downy mildew resistance, and Fusarium basal rot and pink‐root resistance illustrate how proprietary control can extend beyond individual varieties to the genetic and technological components used in their development and deployment. At the same time, the role of cytoplasmic male sterility is paradoxical: while it can reinforce proprietary control by preventing reproduction of commercial hybrids, it can facilitate subsequent breeding and trait introgression once relevant patent protection has expired or lapsed. Onion breeding therefore illustrates how legal, biological, technological, and informational mechanisms can operate cumulatively to shape practical breeding freedom, raising broader questions about the balance between incentives for innovation and meaningful access to genetic resources.
