Comprehensive Doctrinal & Procedural Analysis of Latgale District Court Rulings and Enforcement Proceedings (2025–2026): The "Brodi" Property Case

Comprehensive legal and procedural analysis of the 2025–2026 proceedings before the Latgale District Court of Latvia concerning the enforcement and judicial sale of the real estate property “Brodi”, the procedural protection of the debtor, and judicial review of the actions of a sworn bailiff. The publication examines a chronological body of court rulings and enforcement-related procedural acts involving Diks Ancveirs, SIA “SF MGMT collateral”, and sworn bailiff Anita Kalniņa. It analyses applications for interim protection, ancillary complaints, security-deposit requirements, territorial jurisdiction, complaints under Section 632 of the Latvian Civil Procedure Law, suspension of enforcement, and subsequent procedural decisions. Particular attention is given to access to justice, proportionality of procedural barriers, effective judicial protection, equality of arms, property rights, and the practical effectiveness of remedies under Article 92 of the Constitution of Latvia, Article 6 and Article 1 of Protocol No. 1 to the European Convention on Human Rights, and Article 47 of the Charter of Fundamental Rights of the European Union. The study includes a procedural chronology, doctrinal analysis of individual court rulings, examination of the conduct of enforcement proceedings, and a bilingual Latvian–English legal assessment.
