FHESS COMMUNICATION XIII — GERMANY >< NICARAGUA — CONFIGURATIVE INTERESTS, CARE GRAMMAR, REPRESENTATIONAL ACCESS AND FUTURE FREEDOM

FHESS Communication XIII examines the Germany >< Nicaragua configuration arising from ICJ Case No. 193, Alleged Breaches of Certain International Obligations in respect of the Occupied Palestinian Territory (Nicaragua v. Germany), following the public hearings on Germany’s preliminary objections held from 7 to 10 September 2026. The communication develops a configurative reading of multiple distinct interests involving Germany, Nicaragua, Israel, Palestine, Palestinian affected persons, Israeli affected persons, the International Court of Justice (ICJ), and the International Criminal Court / Office of the Prosecutor (ICC/OTP). Rather than determining those interests or adopting an adjudicative position, FHESS introduces a CONFIGURATIVE INTEREST POSITION in which distinct interests remain attributable to their own positions while their relational relevance becomes readable. The study distinguishes FUNCTION >< ACCESS, develops CARE GRAMMAR, CARE INVITATION, SELFGRAMMAR, SELF-REPRESENTATION, ICC ACCESS, ICC KRINEIN, INTER(IM)-ACTION, VERWEERRUIMTE, and FUTURE FREEDOM. Particular attention is given to the distinction between the inter-State judicial configuration before the ICJ and possible forms of institutional availability within the existing ICC Situation in the State of Palestine. Article 15 information access is examined without treating ICC access as a predetermined requirement for individual criminal assessment. Communication XIII therefore formulates a differentiated care invitation: each position retains its own interest and voice and may itself determine whether information, damage positions, safeguards or other considerations should be made institutionally readable. The ICC/OTP retains its independent competence to determine the relevance, legal qualification and institutional response, if any. The record includes five preparatory documents, XIII-A through XIII-E, covering the factual and temporal reconstruction, research encounter and finding sequence, configurative care position, ICC entry grammar, and representational field.
