Effective Judicial Protection in Enforcement Proceedings: Case No. 3-11/0111
This publication provides an in-depth doctrinal and procedural analysis of judicial enforcement proceedings in Case No. 3-11/0111 before the Latgale District Court (Preiļi Courthouse), concerning enforcement case No. 00659/016/2025 and the “Brodi” property. The study examines access to effective judicial protection, judicial review of bailiff actions, suspension of enforcement, procedural admissibility, security-deposit requirements, appellate review and the consequences of procedural delay. Particular attention is given to the interaction between Sections 133 and 632 of the Latvian Civil Procedure Law and the guarantees arising from Articles 92 and 105 of the Constitution of Latvia, Article 6 ECHR, Article 1 of Protocol No. 1 to the ECHR, and Article 47 of the Charter of Fundamental Rights of the European Union. The publication is based on court decisions, procedural documents and supporting documentary evidence and is intended for academic, comparative-law and institutional examination.
