Court Delay, Social Care and Proportionality of Enforcement in Latvia: A Bilingual Legal Analysis Tiesas procesa vilcināšanās, sociālā aprūpe un piespiedu izpildes samērīgums Latvijā: divvalodu juridiskā analīze
This bilingual legal report examines the effectiveness and timeliness of judicial protection in Latvia in the context of civil enforcement and the social-care needs of a vulnerable person with a disability. The report analyses whether the relevant authorities acted with sufficient urgency, coordination and proportionality after being informed of serious functional limitations, the need for home care, the author’s restricted financial capacity, and the practical importance of a vehicle for employment and informal care. The evidence dossier records, among other matters, Group II disability and significant functional limitations; a Riga Social Service decision granting provider-based home-care services from 8 April 2026; the author’s job-seeker status and submitted financial information; enforcement proceedings concerning a vehicle; and the death of Biruta Salceviča on 29 August 2026. The report distinguishes carefully between established facts, the author’s account, legal assessment and matters requiring further evidence. The death certificate proves the fact and date of death but does not establish its medical cause. Accordingly, the report does not claim that the court, the social service or the bailiff caused the death. It identifies grounds for an independent examination of whether the institutional response was timely, adequate and capable of providing practical and effective protection before irreversible consequences arose. The legal analysis addresses Article 92 of the Constitution of Latvia, Articles 2, 6 and 13 of the European Convention on Human Rights, Article 1 of Protocol No. 1, the Latvian Civil Procedure Law, the Social Services and Social Assistance Law, the Law on Judicial Power, the UN Convention on the Rights of Persons with Disabilities and, where a sufficient connection with EU law can be demonstrated, Articles 17 and 47 of the Charter of Fundamental Rights of the European Union. The publication contains a 15-page bilingual legal analysis followed by a publicly redacted evidence dossier. Sensitive personal identifiers have been removed from the public version. Latviski Šajā divvalodu juridiskajā ziņojumā analizēta tiesas aizsardzības efektivitāte un savlaicīgums Latvijā saistībā ar civiltiesisku piespiedu izpildi un personas ar invaliditāti sociālās aprūpes vajadzībām. Ziņojumā izvērtēts, vai atbildīgās institūcijas rīkojās pietiekami steidzami, koordinēti un samērīgi, zinot par personas funkcionālajiem ierobežojumiem, nepieciešamību pēc aprūpes mājās, autora ierobežotajām finansiālajām iespējām un transportlīdzekļa praktisko nozīmi darba meklēšanā un neformālās aprūpes nodrošināšanā. Publikācijā tiek stingri nošķirti dokumentāri pierādīti fakti, autora sniegtā informācija, juridiskais vērtējums un apstākļi, kuru pierādīšanai nepieciešami papildu materiāli. Miršanas apliecība pierāda nāves faktu un datumu, bet nepierāda medicīnisko nāves cēloni. Ziņojumā netiek apgalvots, ka tiesa, Sociālais dienests vai tiesu izpildītājs izraisīja personas nāvi.
