Notice of Active Intellectual Property Dispute and Misappropriation of Authorship
(English) This official notice declares an active intellectual property and authorship dispute regarding the publication "The Effect of Motion on the Perception of Material Appearance" (ACM SAP, 2019; DOI: 10.1145/3343036.3343122). The first and corresponding author, Ruiquan Mao, formally revokes the scientific validity of the publication, citing severe academic coercion, deception, and methodological flaws imposed by co-authors and thesis supervisors. Furthermore, this notice highlights the unauthorized integration of this core research and data into the doctoral thesis titled "Learning visual appearance perception, modeling and editing" by Manuel Lagunas, supervised by Belén Masiá and Diego Gutiérrez at the University of Zaragoza (2021). Due to these active legal risks, the Spanish national academic database Dialnet officially removed this thesis from its public system on July 6, 2026. Additionally, on July 7, 2026, the international academic platform ResearchGate forcibly removed the associated publication page due to unauthorized distribution and compliance issues. Crucially, on August 31, 2026, the Provincial Prosecutor's Office of Zaragoza issued and officially notified the University of Zaragoza of an Official Decree (Investigation Proceedings 0000103/2026, NIG: 5029773220260000230) objectively confirming that the doctoral candidate "omitted all citations or bibliographic mentions of the rest of the co-authors" and that the thesis supervisors "knew and consented to it", expressly qualifying this as an "academic fault to be sanctioned with disciplinary measures". Presented under an evasive "Monograph" modality, this act constitutes a clear breach of Spanish Intellectual Property Law (LPI Art. 7.2), Civil Code (Art. 6.4), and international copyright standards under the Berne Convention, which mandates the explicit, uncoerced consent of all co-authors. Consequently, the first author maintains that the academic degree awarded to Manuel Lagunas lacks a lawful foundation under Article 47.1.f of the Spanish Ley 39/2015 due to the fraudulent incorporation of misappropriated research. This notice serves as a formal public demand for the University of Zaragoza to initiate an official review procedure (Revisión de oficio) to investigate these facts involving Manuel Lagunas, Belén Masiá, and Diego Gutiérrez, and to determine the appropriate administrative and legal revocations. Full evidentiary documentation, including verified audio recordings and witness testimonies, is preserved securely for judicial, legal, and institutional review. (Español) Este aviso oficial declara una disputa activa de propiedad intelectual y autoría en relación con la publicación "The Effect of Motion on the Perception of Material Appearance" (ACM SAP, 2019; DOI: 10.1145/3343036.3343122).
