COMMUNICATION IV-A — ICC JUDGES UNDER HYBRID PRESSURE

Communication IV-A to the International Criminal Court — Situation in Ukraine. This communication examines coercive measures affecting ICC judges through the generalisable finding object THE JUDGE IN FUNCTION and asks how pressure upon the human position of judges may affect the JUDICIAL ACTION SPACE from which their judicial functions are exercised independently. Its central finding is: AN INSTITUTION CAN BE AFFECTED THROUGH THE ACTION SPACE OF THE PERSON WHO CARRIES ITS FUNCTION. The communication examines FAIR PLAY, judicial independence, privileges and immunities, judicial well-being, CARE, resilience, HYBRID PRESSURE and VERWEER (defensive capacity/self-protection) in relation to the preservation and restoration of the degrees of freedom required for independent judicial performance. Particular attention is given to Articles 40, 48 and 70 of the Rome Statute, the ICC Code of Judicial Ethics, the Agreement on the Privileges and Immunities of the International Criminal Court, and Rule 162 of the Rules of Procedure and Evidence. HYBRID PRESSURE makes cross-domain effects upon the same judicial action space readable.
