Popis (CZ) Text se zabývá napětím mezi potřebou technické návaznosti u etapovitě rekonstruovaných nemocnic a zásadou zákazu diskriminace v zadávání veřejných zakázek. Ukazuje, že zákon standardizaci umožňuje, avšak zadavatelé této možnosti využívají jen zřídka kvůli riziku námitek. Rozlišuje mezi standardem vydaným účelově pro jednu zakázku a standardem zakotveným v systému managementu kvality zadavatele a navrhuje řešení na úrovni prováděcí vyhlášky, nikoli novely zákona. Descriptipon (EN) The text addresses the tension between the need for technical continuity in hospitals reconstructed in stages and the principle of non-discrimination in public procurement. It shows that the legislation permits standardisation, yet contracting authorities rarely make use of this option because of the risk of objections. It distinguishes between a standard issued for the purposes of a single contract and one embedded in the contracting authority's quality management system, and proposes a remedy at the level of an implementing decree rather than an amendment to the act.
