Diversion in Criminal Proceedings Against Legal Persons in the Czech Republic as an Alternative to Punishment? Potential and Risks of Non-Trial Resolutions

This article examines the purpose of corporate criminal liability, a concept not yet firmly established in theory. A proper definition of this purpose – one that respects the specific nature of legal entities – gives an answer to the question of what we expect to achieve by holding corporations criminally liable. It is though crucial to develop effective means of achieving these goals. Is diversion capable of fulfilling this purpose and under what conditions? Article addresses this question, taking into account experiences from foreign legal systems, based on the new diversion in criminal proceedings against legal entities under Czech criminal law.
