The Contemporary Challenges Facing Family Preservation Regulations in the Islamic Law (A Descriptive Analytical Study)

This research investigates the regulations for preserving the family in Islamic Sharia amidst contemporary challenges, addressing the persistent threats that jeopardize the family unit across different eras. The research problem centers on how to confront modern challenges that undermine the family structure, particularly in light of the decline in positive familial roles and the emergence of social crises resulting from the absence of human and Sharia-based objectives (Maqasid) in its formation. The significance of this study arises from the increasing prevalence of familial issues despite growing international and regional interest in the family. Adopting a descriptive-analytical approach, the researcher describes and analyzes the concept of the family, its functions, and its objectives, followed by a critique of contemporary challenges and an elucidation of the Sharia regulations designed to protect the family. The findings reveal that the challenges facing the family are intellectual, value-based, moral, social, economic, and technological. Islamic Sharia has established these regulations as fixed criteria capable of addressing all challenges, regardless of their nature or evolution, ensuring the family's stability. These include preventive regulations that protect the family before its formation and precautionary regulations that preserve it thereafter.
