Enforcement Costs and Effective Judicial Protection in Latvia
This legal memorandum examines the transparency, calculation and procedural review of enforcement costs in Latvian civil enforcement proceedings, based on documented enforcement files and official communications issued between 2025 and 2026. The study focuses on a documented discrepancy concerning EUR 807.47 in stated enforcement remuneration, including a EUR 580.62 proportional component, and the subsequent clarification that the amount had not been actually recovered and that no separate statutory calculation had been prepared for that amount. The analysis addresses the legal distinction between accrued and contingent enforcement costs, deductions from unemployment benefits, access to calculation data, procedural safeguards under Latvian Civil Procedure Law, Article 92 of the Constitution of Latvia, and, where EU law is engaged, Article 47 of the Charter of Fundamental Rights of the European Union and Directive 93/13/EEC. The memorandum further examines whether ambiguities in standardized enforcement communications may impair legal certainty and the practical effectiveness of judicial review. It concludes by identifying issues requiring institutional and supervisory examination, including the transparency of calculation methods, access to essential enforcement information, protection of statutory minimum income, and the distinction between actually accrued costs and prospective remuneration.
