CONSTITUTIONAL IDENTITY IN REPLAY-AUTHORITATIVE SYSTEMS Sameness as a Constitutional Condition for Replay-Authoritative Determination

The Constitutional Replay-Authority corpus has established the primitive architecture necessary for replay-authoritative determination, including Authority Origination, Authority Singularity, Governance Freezing, Explicit Materialization, and Fail-Closed Design. Each of these contributions presupposes that the objects upon which replay-authoritative determination operates — decisions, authority surfaces, policy states, registries, and decision capsules — can be recognized across time as the same constitutional subjects they were when legitimacy was originally formed. This paper supplies the missing constitutional condition. It distinguishes Authoritative Constitutional Identity, which applies strictly to those elements that participate directly in the Authority Singularity, from Evidentiary Supporting Identity, which applies to non-authoritative materials that may assist identity analysis without themselves carrying constitutional authority. The paper argues that replay-authoritative determination cannot proceed with integrity unless the system can establish Authoritative Constitutional Identity with respect to the original decision condition constituted within the Authority Singularity. Without such identity, replay necessarily collapses into evidentiary reconstruction rather than authoritative constitutional verification. The paper concludes that Authoritative Constitutional Identity closes the gap between the origination of authority and the preservation of authority-bearing subjects across replay events.
