Technical Evidence and Function-Level First Amendment Coverage After Moody
This note records a structural level mismatch in post-Moody adjudication, where function-level First Amendment coverage is built from technical descriptions of algorithms, system design, automation, ranking, recommendation, and human involvement. In the absence of an exposed conversion condition, the adjudicative move from technical description to function-level coverage does not operate as status-bearing; it substitutes the level shift for a status-bearing connection.
