The Klokkenluider's Paradox: Late Transposition, Limited Mandate, and the Implementation Gap Between the EU Whistleblower Directive and Dutch Practice

Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report breaches of Union law (the EU Whistleblower Directive) imposed binding obligations on Member States to establish internal and external reporting channels, prohibit retaliation, ensure confidentiality of the reporting person's identity, provide effective remedies, and reverse the burden of proof in retaliation proceedings. The transposition deadline was 17 December 2021 for public-sector and large private-sector entities, and 17 December 2023 for medium-sized private entities. The Netherlands missed the December 2021 deadline by more than fourteen months: the Wet bescherming klokkenluiders entered into force on 18 February 2023. The European Commission opened infringement proceedings against the Netherlands and other Member States for late transposition in February 2022 under Articles 258–260 TFEU. The Huis voor Klokkenluiders (House for Whistleblowers), established by the Wet Huis voor Klokkenluiders of 2016 and reorganised under the 2023 legislation, is the Dutch competent authority for external reports and for advice to reporting persons. The Algemene Rekenkamer audit of the Huis voor Klokkenluiders (2020) found mandate-execution problems including limited investigation capacity and unmet performance expectations. Despite the formal transposition, the documentary record raises questions concerning the substantive effectiveness of Dutch whistleblower protection.
