The Regulatory Arbitrage Window: How Cross-Border AI Governance Asymmetries Create Strategic Opportunities and Risks
AI governance regimes are diverging across jurisdictions at a pace that creates both strategic opportunity and compliance peril for multinational enterprises. The European Union’s AI Act establishes the world’s most comprehensive risk-tiered regulatory framework. China enforces algorithmic recommendation and deepfake regulations with distinct compliance logics and enforcement mechanisms. India’s Digital Personal Data Protection Act creates data localization obligations without a binding AI-specific framework. The United States maintains a sector-specific patchwork of state and federal rules with no comprehensive federal AI legislation. This divergence creates what this paper terms the Regulatory Arbitrage Window - a transitional period during which multinational enterprises can exploit jurisdictional asymmetries in AI regulation for competitive advantage, but also face mounting compliance complexity, reputational risk, and the accumulation of what this paper terms compliance debt: the future cost of retroactively meeting standards that the enterprise chose not to meet when they were optional. This paper maps the current AI regulatory landscape across twelve major markets, identifies the specific arbitrage opportunities and risks for AI-deploying enterprises, and proposes the Regulatory Convergence Readiness (RCR) framework - a strategic compliance approach that prepares companies for the eventual harmonization of AI governance standards while operating effectively in the current fragmented environment. The central argument is that companies optimizing for current regulatory minimums are building compliance debt that will prove substantially more costly to discharge than proactive convergence-ready strategies would have cost to implement. The paper concludes with implications for Chief Legal Officers structuring global AI compliance, corporate strategists navigating regulatory fragmentation, and policy analysts assessing the trajectory of international AI governance harmonization.
