La acción por daños y perjuicios causados por la Unión Europea y la obligación de reparar las violaciones graves de derechos humanos: hacia un marco internacional reforzado de rendición de cuentasThe action for damages caused by the European Union an

Abstract The EU seeks to play an increasingly significant role on the international stage, which makes it essential to examine in depth its responsibility for potential violations of fundamental rights in the framework of its external action, particularly in relation to Missions deployed under the CFSP. Within this framework, the non-contractual liability action is emerging as a key legal instrument to ensure the effective reparation of damage caused by unlawful conduct attributable to the Union. This paper analyses, in light of the KS and KD v. Council case, the potential scope and implications of this mechanism as a means of giving concrete effect to the obligation to remedy serious human rights violations. It contends that such an obligation stems not only from international law, but also from the structural principles of EU law, including effective judicial protection and the rule of law.
