West Virginia sued over OTC moratorium
The organization of treatment and harm reduction programs in West Virginia is suing the state for not allowing new methadone treatment centers to be built. The moratorium against new opioid treatment programs (OTPs), the only programs allowed to treat opioid use disorder with methadone in West Virginia, is nearing its two‐decade mark (see “Methadone Overdose Deaths Lead to Restrictive Bills in West Virginia,” ADAW February 2, 2007; https://onlinelibrary.wiley.com/doi/10.1002/adaw.20076 ). This month, Solutions Oriented Addiction Response of West Virginia (SOAR‐WV) filed a lawsuit in U.S. District Court for the Southern District of West Virginia asserting the moratorium violates Title II of the Americans with Disabilities Act and Section 504 of the Rehabilitation Act. SOAR‐WV is represented by the American Civil Liberties Union of West Virginia (ACLU‐WV), the American Civil Liberties Union (ACLU), and the law firm Kaplan & Grady.
