Sobre el concepto de trabajo o servicio forzado en el delito de trata de personas del artículo 411 quater

The crime of human trafficking defined in Article 411 quater includes various goals pursued by the offender. This study will focus exclusively the objective of subjecting the victim to "forced labor or services, servitude, slavery, or similar practices".It starts from the premise that there is significant ambiguity surrounding the scope of these expressions. This diagnosis is supported by unclear jurisprudence, which results, on one hand, from a lack of doctrinal interest in this phenomenon and, on the other, from the inherent ambiguity in the relationship between criminal law and labor law. With these premises identified as causes of this opacity, some interpretative keys offered by comparative discussion will be explored for better understanding. The conclusion suggests a clearer scheme of crimes that involve subjecting another person to forms of labor abuse that are no longer only relevant to labor law contexts.
