Nationality of Natural Persons in International Law a Teleological Approach
The present dissertation aims to formulate a theory of what the purpose of nationality might be in international law. Furthermore, it aims to examine the limits international law imposes on States when it comes to nationality conferral and loss. And finally, it aims to assess whether said limits align with the proposed purpose of nationality. In doing so, we found that indeed, the limits related to diplomatic protection, the principle of good faith, sovereignty and human rights align with and reflect the proposed telos of nationality in international law. It is submitted that the findings of this work might help to better conceptualize the legal nature of the international legal norms surrounding nationality and to better structure its components.
