From Cross-Border Marriages: Conflict of Laws and Jurisdictional Challenges
Cross-border marriages have proliferated due to globalization, migration, and transnational employment. Such marriages signify cultural integration; yet, they also engender complex legal issues pertaining to conflict of laws, jurisdiction, and the enforcement of foreign marriage decrees. Due to India's incomplete private international law framework, courts have heavily depended on judicial interpretation and established concepts of comity, domicile, and public policy. This research paper rigorously examines the legal framework for cross-border marriages in India, with a special emphasis on conflicts of laws and jurisdictional issues. The paper highlights the shortcomings of the existing system by analyzing statutory provisions and key judicial decisions, therefore emphasizing the necessity for legislative reform to protect the rights of affected spouse
